Article 1: Purpose
These General Terms and Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of Products offered by the company STRUCTVITALITY LTD and the websites www.structwater.com, www.structwater.fr, www.structwater.be, www.strucwater.uk, www.structwater.ch
Article 1.2: General Provisions
These General Terms and Conditions of Sale (GTCS) apply to all sales of Products and services made through the website www.structwater.com and domain names mentioned in Article 1, which are an integral part of the Contract between the Buyer and the Seller. The Seller reserves the right to modify these terms at any time by publishing a new version on its website.
The applicable GTCS are those in effect on the date of payment (or the first payment in the case of multiple payments) of the order. These GTCS can be viewed on the Company’s website www.structwater.com and domain names mentioned in Article 1. The Company also ensures that their acceptance is clear and unreserved by implementing a checkbox and a validation click. The Customer declares to have read all of these General Terms and Conditions of Sale, and where applicable, the Special Terms and Conditions of Sale related to a product or service, and to accept them without restriction or reservation.
The Customer acknowledges that they have received the necessary advice and information to ensure the suitability of the offer to their needs.
The Customer declares to be legally capable of contracting under Belgian and European laws or to validly represent the natural or legal person for whom they are committing. Unless proven otherwise, the information recorded by the Company constitutes proof of all transactions.
Article 2: Price
The prices of products sold by www.structwater.com and domain names mentioned in Article 1 are indicated in Euros including all taxes and excluding specific shipping costs (precisely determined on the Product description pages). For all products shipped outside the European Union and/or French Overseas Territories, please contact us directly via the contact request form (any attempt to purchase via the site will be refused).
Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These duties and sums are not the responsibility of the Seller. They will be borne by the buyer and are their responsibility (declarations, payment to the competent authorities, etc.). The Seller invites the buyer to inquire about these aspects with the corresponding local authorities.
The Company reserves the right to modify its prices at any time for the future. The telecommunication costs necessary to access the Company’s websites are the responsibility of the Customer. Where applicable, delivery costs are also the responsibility of the Customer.
Article 3: Conclusion of the Online Contract
The Customer must follow a series of specific steps for each Product offered by the Seller to complete their order. However, the steps described below are systematic:
- Information on the essential characteristics of the Product (on the web page of the product in question);
- Choice of the Product, its options where applicable, and indication of the Customer’s essential data (identification, address…);
- Acceptance of these General Terms and Conditions of Sale.
- Verification of the order details and, if necessary, correction of errors.
- Following instructions for payment, and payment for the products.
- Delivery of products. The Customer will then receive confirmation of the order payment by email, as well as an acknowledgment of receipt of the order confirming it. They will receive a .pdf copy of these general terms and conditions of sale. For delivered products, delivery will be made to the address indicated by the Customer and only after receipt of full payment. For the purpose of successful completion of the order, the Customer undertakes to provide truthful identification details.
The Seller reserves the right to refuse the order, for example for any abnormal request, made in bad faith, or for any legitimate reason.
Article 4: Products and Services
The essential characteristics of the goods, services, and their respective prices are made available to the buyer on the company’s websites. The customer certifies having received a breakdown of delivery costs as well as the terms of payment, delivery, and execution of the contract. The Seller undertakes to honor the Customer’s order only within the limits of available Product stocks. Otherwise, the Seller shall inform the Customer. This contractual information is presented in detail and in the French language.
In accordance with European law, they are subject to a summary and confirmation during the validation of the order. The parties agree that the illustrations or photos of the products offered for sale have no contractual value. The period of validity of the offer of the Products as well as their prices is specified on the Company’s websites, as well as the minimum duration of the proposed contracts when these relate to a continuous or periodic supply of products or services. Unless special conditions apply, the rights granted hereunder are granted only to the natural person signing the order (or the person holding the email address provided).
In accordance with legal provisions regarding conformity and hidden defects, the Seller refunds or exchanges defective products or those not corresponding to the order. The refund can be requested in the following manner:
1/ Notification by email with photos (if visual proof is possible).
2/ Acceptance (or refusal according to conditions) of the refund or exchange request.
3/ Submission of requested documents.
4/ Collection of equipment and replacement (if agreed).
5/ Refund by check or bank transfer in the customer’s name.
Article 5: Retention of Title Clause
The products remain the property of the Company STRUCTVITALITY LTD until full payment of the price.
Article 6: Delivery Terms
Products are delivered to the delivery address indicated during the order process and within the specified timeframe. This timeframe does not include the order preparation time.
In case of a shipping delay, we will inform you by email of the delay of your order.
The Seller provides a contact email indicated in the order confirmation email to ensure order tracking.
The Seller reminds that at the moment the Customer takes physical possession of the products, the risks of loss or damage to the products are transferred to them. It is the Customer’s responsibility to notify the carrier of any reservations regarding the delivered product. Similarly, the customer undertakes to check the integrity of the package before accepting it.
Article 7: Availability and Presentation
Orders will be processed within the limits of our available stocks or subject to available stocks from our suppliers. In the event of an item being unavailable for a period exceeding 15 business days, you will be immediately notified of the foreseeable delivery times and the order for this item may be canceled upon simple request. The Customer may then request a credit note for the amount of the item or its refund.
Article 8: Payment
Payment is due immediately upon ordering. The Customer can make payment by payment card or bank check. Cards issued by banks domiciled outside of Belgium must be international bank cards (Mastercard or Visa). Secure online payment by bank card is carried out by our payment provider. The information transmitted is encrypted and protected by the SSL Internet exchange security protocol.
Once the payment is initiated by the Customer, the transaction is immediately debited after verification of the information. In accordance with Article L. 132-2 of the Monetary and Financial Code, the commitment to pay given by card is irrevocable. By providing their banking information during the sale, the Customer authorizes the Seller to debit their card for the amount relating to the indicated price. The Customer confirms that they are the legal holder of the card to be debited and that they are legally entitled to use it. In case of error, or impossibility to debit the card, the Sale is immediately terminated by operation of law and the order canceled.
Article 9: Right of Withdrawal
Upon receipt of the product, the customer must check the quantity, condition, and conformity with their order. If the customer is not satisfied with the product received, they have a period of fourteen clear days from receipt to return it to:

Article 10: Warranties
In accordance with the law, the Seller assumes two warranties: of conformity and relating to hidden defects of the products. The Seller refunds the buyer or exchanges products that are apparently defective or do not correspond to the order placed.
The refund request must be made in the following manner:
1/ Notification by email with photos (if visual proof is possible).
2/ Acceptance (or refusal according to conditions) of the refund or exchange request.
3/ Submission of requested documents.
4/ Collection of equipment and replacement (if agreed).
5/ Refund by check or bank transfer in the customer’s name.
The Seller reminds that the consumer has a period of 15 DAYS from the delivery of the goods to take action against the Seller.
Additional warranties: All products are under a 5-year warranty
Article 11: Complaints
If applicable, the Buyer may submit any complaint by contacting the company using the contact form or by sending a letter to the address mentioned in Article 9.
Article 12: Force Majeure
The performance of the seller’s obligations hereunder is suspended in the event of a fortuitous event or force majeure that prevents its execution. The seller will notify the customer of the occurrence of such an event as soon as possible.
Article 13: Nullity and Modification of the Contract
If one of the stipulations of this contract were to be annulled, this nullity would not result in the nullity of the other stipulations which will remain in force between the parties. Any contractual modification is only valid after a written and signed agreement of the parties.
Article 14: Protection of Personal Data
In accordance with the Data Protection Act, you have the right to inquire, access, modify, oppose, and rectify personal data concerning you. By adhering to these general terms and conditions of sale, you consent to our collection and use of this data for the fulfillment of this contract. By entering your email address on one of the sites in our network, you will receive emails containing information and promotional offers concerning products published by the Company and its partners.

Article 15: Applicable Law
All clauses appearing in these general terms and conditions of sale, as well as all purchase and sale operations referred to therein, shall be subject to French law.
Article 16: Liability
The liability of STRUCTVITALITY LTD is not engaged for any indirect damage, loss of business, loss of profit, loss of opportunity, damage, or costs.
Article 17: Intellectual Property
All elements of the commercial documents and the STRUCTVITALITY LTD website, whether visual or sound, including the underlying technology, are protected by copyright, trademarks, or patents. They are the exclusive property of the company STRUCTVITALITY LTD or its suppliers, the latter granting no license nor any right other than that of consulting the website in particular. The reproduction or use of all or part of these elements is only authorized for the exclusive purpose of information for personal and private use; any reproduction and any use of copies made for other purposes are expressly prohibited. Any other use constitutes infringement and is sanctioned under Intellectual Property, unless prior written authorization is obtained from STRUCTVITALITY LTD.
Article 18: Modification of the General Terms and Conditions of Sale
STRUCTVITALITY LTD reserves the right to modify these general terms and conditions of sale at any time and without notice. The modified general terms and conditions of sale will apply to orders placed after the public dissemination of the new conditions, notably on the website. Before placing an order, the customer is invited to consult the website to ensure the current terms of sale.
Article 19: Promotional Offers
In the event of a promotional offer, it is limited to the prices and/or products indicated on STRUCTVITALITY LTD commercial documents, on its paper catalog, or on its website and within the limits of available stocks. The promotional offer is subject to the specific conditions governing it, particularly regarding its duration, which is always limited in time. Once the deadline has passed, STRUCTVITALITY LTD cannot guarantee the availability of the products in these offers.
Article 20: Precautions for Use and Important Warning
Products from STRUCTVITALITY LTD must not be near electronic or computer equipment, bank cards, magnetic strips… and any device likely to be disturbed by a magnetic field.
Products from STRUCTVITALITY LTD are not recommended to be near pacemaker wearers and pregnant women during the first three months of pregnancy.
Products from STRUCTVITALITY LTD are not a substitute for medical treatment.
The company STRUCTVITALITY LTD declines all responsibility regarding the medical consequences of the products sold, the customer being solely responsible for their use.
